In a blatant display of judge shopping, defendants Megan McMahon and Taryn Burnett have requested in writing that a particular judge, Justice Earl Wilson, be assigned to case manage the defamation and harassment lawsuit against them, without the Plaintiff's consent.
The judge happens to be the same case management judge for the underlying action and their request was in fact made while a recusal application was in progress to remove the judge, brought under advisement of a legal opinion, in the underlying action. Prior to the eventual hearing of the recusal application, the Plaintiff under legal advisement had attempted to have the recusal application heard since March 2013.
Judge shopping is the act of looking for a judge who will rule in one's favour and is known to erode the public's confidence in the administration of justice.
